The Superior Court of Quebec dismissed an application by the plaintiff for a provisional injunction before trial which would have required the individual defendant and the newspaper to withdraw an article on the newspaper’s internet site and all other related platforms within 14 hours.  The Court applied the same stringent test as common law courts in the other provinces and rejected the motion because it could not conclude “that the words are so manifestly defamatory and impossible to justify” that the defamation action was bound to succeed.
