Lande c. Feldman, 2020 QCCS 3782

The Quebec Superior Court dismissed an application by the plaintiffs for a provisional injunction to restrain the defendant from communicating defamatory allegations to the news media.  A major Montreal newspaper had published an article on October 31, 2020 on its website which reported on this defamation litigation and the allegations made by the defendant.  The article, which was published on two websites, contained images of the plaintiffs’ house, their address and a photo of the male plaintiff, which he had not authorized.  The Court rejected the plaintiffs’ submissions that a state of urgency existed which would allow the Court to grant an injunction at this provisional stage.
