Glecer c. Douek, 2015 QCCS 5397
The Quebec Superior Court dismissed a defence application to strike out a defamation lawsuit relating to the transmission by email to various persons of the text of a judgement of the Rabbinical Court of Geneva (Switzerland). The Court held that the question of injury to reputation, if any, should be determined at trial. Under Quebec law, the communication in certain instances of true information may be actionable: Prudhomme c Prud’homme, [2002] 4 R.C.S. 663.
