Sun v. Ao, QCCS 3322
The Quebec Superior Court awarded the plaintiff $7,000 moral damages and $2,500 punitive damages over defamatory remarks by the defendant in a Mandarin language chat group aimed at members of the Chinese community. In assessing damages, the court found that the defamatory remarks did not appear to have had a lasting effect on the plaintiff’s reputation, noting that the dissemination was limited and the chat group was small. Some of the defamatory exchanges took place when no more than ten people had access to them.
