Ralph v. Burgess, 2024 NLSC 162

The Supreme Court of Newfoundland and Labrador, General Division, awarded $45,000 damages to the plaintiff over a defamatory email sent by the defendant to the plaintiff’s employer. The defendant did not appear at the trial and the court specifically found that the accusations in the email were untrue and that the defendant “made no effort to verify the serious allegations made to him”. Further, the Court stated “[t]here was no basis for communicating these allegations to the employer as they bore no relation to [the plaintiff’s] employment.”
