Garcia Carrillo v. Delgado Orozco, 2026 QCCS 191

The Superior Court of Quebec awarded $10,000 non-pecuniary damages to the plaintiff Garcia against the defendant Delgado over defamatory statements made in a conversation with the co-defendant Pablo Bohorquez that was broadcast on the latter’s YouTube channel from November 16, 2022 to December 6, 2022.  The video was viewed more than 27,000 times before it was taken down following a provisional ex parte injunction.  The Court also granted a permanent injunction requiring removal of the video from Bohorquez’ YouTube channel, destruction of the video, and the prohibition of defamatory statements related to the original interview.  [Note that in an earlier hearing in the same case on July 4, 2023, a different judge of the Quebec Superior Court had ordered the defendant Bohorquez to pay $10,000 non-pecuniary damages to Garcia.]
