Browne v. Picart, 2026 ONSC 3308
The Divisional Court of the Ontario Superior Court of Justice dismissed the defendant’s appeal from a Deputy Judge’s decision that his blog post about the two plaintiffs was defamatory and not protected by a fair comment defence. The Division Court also rejected the defendant’s argument that the Deputy Judge erred in awarding defamation damages of $35,000 to each of the plaintiffs. “Mr. Browne’s blog was published on the Internet which can reach a large audience and remains there to be viewed. Mr. Browne refused a request to take down his defamatory blog post.”
