2025 08 11 Smith v. Nagy, 2025 ONSC 4629 

The Ontario Superior Court of Justice awarded the plaintiff $40,000 general damages over a defamatory Facebook post by his ex-wife which was shared over 900 times, received more than 2000 likes, and over 200 comments in response.  The Court held the defendant decided to make the post as public as possible and stated she wanted to ruin the plaintiff’s life. The Court declined to hold the post was malicious; in part, because it found that the purpose of the post was to serve as a therapeutic outlet for the defendant.
