2025 08 08 McKee v. Melew, 2025 YKSC 48 

The Yukon Supreme Court awarded the plaintiff McKey $55,000 general damages and $10,000 aggravated damages and the plaintiff Spurvey $50,000 general damages and $10,000 aggravated damages over dozens of defamatory Facebook posts.  The Court took into account the fact the defendant had violated a pre-trial injunction for several months and made no retraction or apology.  To the contrary, the defendant showed aggressive defiance in response to the plaintiffs’ request for removal of the defamatory posts, an ongoing insistence on his right to post them, and repetition of the accusations in his statement of defence, and evaded service of legal process, and repeatedly failed to appear in court.
