12563789 Canada Inc. v. Tiki Tours International Corp, 2026 ONCA 269

The Ontario Court of Appeal uanimously affirmed an award of $30,000 general damages and $30,000 punitive damages made by the trial judge to the plaintiffs over “a social media campaign attacking them, asserting defamatory and unfounded facts which had the effect of scaring away customers.”  The Court of Appeal also affirmed the trial judge’s exercise of discretion in awarding elevated costs to the plaintiffs for an interloctury injunction they obtained in the course of this litigation.
