12563789 Canada Inc., Mazzotta and Charrier v. Tiki Tours International Corp, Karpishka and Saucedo, 2025 ONSC 1846

The Ontario Superior Court of Justice awarded $30,000 general damages and $30,000 punitive damages to the plaintiffs over “a social media campaign attacking them, asserting defamatory and unfounded facts which had the effect of scaring away customers.” The expression was published on a website headlined with a defamatory title and in posts on Facebook.  The judge found the posts were made on behalf of all three defendants and remained on the Internet, including the website, throughout the summer of 2022.  Affirmed 2026 ONCA 269 on April 14, 2026.
