Marks v. Allen, 2026 BCSC 930
The British Columbia Supreme Court awarded the plaintiff realtor $110,000 general damages and $50,000 aggravated damages for serious defamatory allegations made in a letter, two emails and two posts by the former mayor of a small Fraser Valley community. The plaintiff had been deeply involved in the community and the defamatory posts on Facebook would have reached a large membership relative to the population and became the subject of considerable discussion. The defamatory emails were sent to prominent people in the community.
