Phele v. Colem Morvan, 2026 QCCS 2380

The Quebec Superior Court (Civil Chamber) awarded the plaintiff $30,000 dollars for moral damages against the individual defendant for serious defamatory expression contained in YouTube and Facebook videos seen by 30,000 to 45,000 people.  The individual defendant was also ordered to pay $15,000 punitive damages; the defendant society $1,000 punitive damages.  The Court also ordered the removal of the offending videos and a permanent injunction against similar defamatory expression.  Certain extracts from the judgment were also to be published by the defendants in French and in “creole haitienne”.
