Hanine v. Jerando, 2025 QCCS 2654

The Quebec Superior Court ordered the defendant be imprisoned until such time as he removes 8 defamatory videos from YouTube or any other site on which they may be found.  The court noted this was a repeat offence, and imprisonment was justified by the Quebec Code of Civil Procedure, which authorizes imprisonment where a person refuses to comply with an order or injunction. The defendant was also ordered to perform 150 hours of community service and pay a fine of $10,000 within 45 days. The court’s order also provided that the defendant appear before the court on the 14th day of his incarceration to allow him to demonstrate his intention to comply with the injunctions that led to his conviction for civil contempt of court.
